These Terms and Conditions govern your use of this website. Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not use this website.

1. Use of the website

   The website is provided to you free of charge for your personal use subject to these Terms and Conditions. By using the website you agree to be bound by these Terms and Conditions.

   THESE TERMS AND CONDITIONS DO NOT AFFECT YOUR STATUTORY RIGHTS.

2. Amendments

   We may update these Terms and Conditions from time to time and any changes will be notified to you via a suitable announcement on the website. The changes will apply to the use of the website after we have given notice. If you do not wish to accept the new Terms and Conditions you should not continue to use the website. If you continue to use the website after the date on which the change comes into effect, your use of the website indicates your agreement to be bound by the new Terms and Conditions.

3. Access to and availability of the website

   Belhaven Puns will make all reasonable efforts to provide you with access to the website 24 hours per day without any interruptions. However, from time to time you may experience disruptions due, for example, to essential maintenance or problems beyond our control involving suppliers, communications, the Internet, your own computer or software failures. Accordingly, Belhaven Pubs does not warrant that the website will be available continuously and is not liable for any downtime or disruption in website availability.

4. Passwords and security

   You agree to (and agree to ensure that your directors, employees and agents):

   • keep all passwords secret at all times and have them changed, if there is reason to believe that someone else knows them; and
   • notify us immediately upon becoming aware of any accidental or unauthorised access or use of the service by any third party.

   The content and design of these website pages are subject to copyright owned by Belhaven Pubs. You are welcome to print pages for your personal use but no part of this website, our logos or trademarks may be reproduced or transmitted in any way for any other purpose.

   Other than having permission to access the website and use the services in accordance with these Terms and Conditions, you agree that nothing herein creates or grants to you any right in or ownership of any intellectual property rights existing in the presentation or format of the website or in any software, content, information, data or databases provided through the website or used in or forming part of the services. This includes without limitation any registered or unregistered trade marks, service marks, logos, designs, database rights, copyright, rights in domain names or data owned by or vested in Belhaven Pubs or any third party ("Intellectual Property").

   All rights in relation to Intellectual Property not expressly granted by Belhaven Pubs are hereby reserved to Belhaven Pubs (or its licensors) and no right, licence or benefit to such Intellectual Property is granted to you.

   Belhaven reserves the right to change the details of any hotel or pub at any time without notice.

7. Liability

   The website is provided by Belhaven Pubs without any warranties or guarantees. You must bear the risks associated with the use of the Internet.

   Belhaven Pubs has made all reasonable efforts to ensure that all information provided on the website by ourselves and third parties is accurate at the time of inclusion, complete and up-to-date.

   However, there may be inadvertent errors on the website for which Belhaven Pubs takes no responsibility. Belhaven Pubs reserves the right to make changes and/or corrections to the website at its own discretion.

   In particular, we disclaim all liabilities in connection with the following:

   • technical problems including errors or interruptions of the website
   • unsuitability, unreliability or inaccuracy of the website

   Nothing in this paragraph applies to Belhaven Pubs liability in respect of products sold through our hotels.

   Nothing in these Terms and Conditions shall exclude Belhaven Pubs liability for personal injury or death caused by its negligence.

8. Third party websites and products

   From time to time this website may include links to other websites not under the control of Belhaven Pubs. Belhaven Pubs has no control over, and will accept no liability in respect of, the content on any external link.

   Any information related to a supplier or product on the website which is not part of or produced by the Greene King group does not represent any endorsement by Belhaven Pubs of the quality of the supplier or product offered.

9. Termination

   Belhaven Pubs may terminate your right to use the website by notice in writing to you if you breach any of the obligations under these Terms and Conditions.

   On termination, you will make no further attempt to access the website or use the services and must delete all relevant passwords and any other website material.

10. Your liability

    You agree to be liable for and to indemnify Belhaven Pubs (and its officers, employees, directors, shareholders, representatives, successors and assigns) and hold it harmless against all third party claims, demands and actions and in relation to all liabilities, losses, costs, charges, damages and expenses (including legal fees) incurred in relation to such claims, demands and actions, to the extent that such liability arises from breach of these Terms and Conditions by you or use of your computer, passwords or secure means of access to the website by an unauthorised user.

11. General

    If Belhaven Pubs fails to exercise its rights immediately, this will not by itself be taken as a waiver of those rights and Belhaven Pubs may still exercise those rights in the future.

    If any of these terms or conditions is found to be illegal, invalid or unenforceable under applicable law, the offending provision will be severed and remaining terms and conditions will be unaffected (to the fullest extent legally permitted).

    You agree that Belhaven Pubs may transfer its rights and obligations under these Terms and Conditions to another person. You may not transfer your rights or obligations under these Terms and Conditions to anybody else without first obtaining the written consent of Belhaven Pubs.

    A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.

    Your use of this website and any dispute arising out of the website is subject to the laws of England and Wales. Any dispute arising out of the use or publication of this website is subject to the exclusive jurisdiction of the Courts of England and Wales.

Belhaven Pubs - Members Centre Terms & Conditions

These terms and conditions (the "Terms") govern your participation in the "Belhaven Reward Scheme" and your relationship with Greene King Brewing and Retailing Limited t/a Belhaven ("Belhaven"). If you apply to take part in the Belhaven Reward Scheme or use a discount voucher, you agree to these Terms. Belhaven may refuse an application for any good reason. If you wish to do so, please print and retain a copy of these Terms for your reference.

1. To participate in the Belhaven Reward Scheme, individuals must sign up on line at http://www.oldbankbar-greenock.co.uk/members-signup. [Vouchers can only be downloaded and printed from http://www.oldbankbar-greenock.co.uk/members-centre].
2. Vouchers remain the property of Belhaven and Belhaven is not responsible for any vouchers that are lost or stolen.
3. Each voucher is personal to you and can only be used by member of the Belhaven Reward Scheme. Proof of identity may be required.
4. All participants must be over 18 years of age.
5. All vouchers are non-refundable, cannot be redeemed in connection with any other discount card, voucher or offer and have no cash value
6. Vouchers may not be transferred, traded or sold.
7. Belhaven reserves the right to remove or amend the Belhaven Reward Scheme or make changes to these rules from time to time. Belhaven will provide Members as much notice as is reasonably practicable.
8. DATA PROTECTION. These Terms and Belhaven Privacy Policy, a copy of which can be found at http://www.oldbankbar-greenock.co.uk/#privacy, govern Belhaven’s use of the personal data collected from you.
9. The Belhaven Reward Scheme is promoted by Greene King Brewing and Retailing Limited (the "Promoter") company number 3298903 registered address Westgate Brewery, Bury St Edmunds, Suffolk, IP33 1QT trading as Belhaven.

Prize draws

During the months of May to September 2013 inclusive, all members of the Belhaven Reward Scheme shall be entered into a monthly prize draw when they successfully refer a "Friend" to the Belhaven Reward Scheme during the month.

10. The prize draw is open to all UK residents over 18, excluding employees and their immediate families of the "Promoter", its affiliated companies, their agents or other persons professionally connected with the draw.
11. By taking part in this promotion all participants will be deemed to have accepted and be bound by these terms and conditions.
12. All entries must be submitted online at http://www.oldbankbar-greenock.co.uk/members-centre. The Friend must be a UK resident over 18 excluding employees and their immediate families of the "Promoter", its affiliated companies, their agents or other persons professionally connected with the draw.
13. The Promoter reserves the right to determine the validity of a referral before or after a participant has been entered into a prize draw.
14. No purchase necessary.
15. The opening date for receipt of entries and the closing date for receipt of entries for each monthly prize draw are as follows:

16. The Promoter reserves the right to disqualify incomplete, altered or illegible entries. No responsibility will be accepted for entries lost, damaged or delayed, technical or telecommunications fault. Proof of sending is not proof of receipt.
17. No bulk, machine generated, consumer group or third party entries will be accepted, entries are restricted to one entry per month by any individual.
18. The winners will be notified by email by no later than one week after the monthly prize draw has taken place. All reasonable effort will be made to contact winners however if a winner does not claim their prize within 28 days their prize will be forfeited.
19. The prize for each prize draw is as an iPad mini, 1 prize can be won each month during the promotional period of May 2013 to September 2013.
20. The prizes are non-transferable, non-refundable and cannot be exchanged for any cash alternatives in whole or in part.
21. The Promoter shall not be liable for any defects whatsoever, in respect to the prizes once dispatched to the winners.
22. The Promoter reserves the right to provide an alternative prize of equal or greater value in the event of unforeseen circumstances.
23. Winners may be required to take part in related publicity.
24. The decisions of the Promoter are final and no correspondence will be entered into.
25. The name and counties of the winners will be available between 7/6/13 and 30/11/13 upon application with a SAE to Greene King Brewing and Retailing Limited, Westgate Brewery, Bury St Edmunds, Suffolk, IP33 1QT.
26. By entering the prize draw and registering on this website, you consent to the collection and use of the information you voluntarily submit. Any personal information will only be used in accordance with current UK data protection legislation and will not be disclosed to a third party without the individual's prior consent. All our email correspondence contains an unsubscribe option by which you can opt out of further email contact if you so wish.

28. These Terms are governed by the laws of England and Wales.
